Welcome to Pawfectly Designed. These Terms & Conditions explain how website design and related services are provided, what you can expect from me, and what I need from you to keep your project running smoothly.
By accepting a quotation or booking a service with Pawfectly Designed, you agree to these Terms & Conditions.
1. About Pawfectly Designed
Pawfectly Designed provides website design and related digital services for pet businesses.
Pawfectly Designed is operated by:
S.Hook
Trading as Pawfectly Designed
Email: hello@pawfectlydesigned.co.uk
Location: West Lothian, Scotland
Throughout these Terms & Conditions, “I”, “me”, “my” and “Pawfectly Designed” refer to Pawfectly Designed. “You” and “your” refer to the client.
2. Services
Pawfectly Designed offers services including:
- WordPress website design
- Website refresh and redesign
- SEO setup
- Website care and support
- Website content and branding
- Other website and digital services agreed between us
The exact services included in your project will be set out in your quotation or project agreement.
Anything not specifically included in your quotation is not automatically included in the project.
If you need additional work during your project, I will discuss this with you before carrying it out and, where appropriate, provide an additional quotation.
3. Quotes and Pricing
All quotes are provided based on the information available at the time of enquiry.
Your quotation will set out the services included, the agreed price and, where relevant, the expected project timescale.
Quotes are normally valid for 30 days unless otherwise stated.
A project will not be considered booked until the quotation has been accepted and any required deposit or initial payment has been received.
I reserve the right to review a quotation if the scope of the project changes significantly before work begins.
4. Deposits and Payments
Payment arrangements will be clearly explained in your quotation.
For projects requiring a deposit, work will normally begin once the agreed deposit has been received.
The remaining balance will become due according to the payment schedule stated in your quotation.
For website projects, the remaining balance is due before the website is transferred to the client’s hosting account or made live, unless an alternative payment arrangement has been agreed in writing.
Invoices must be paid by the due date shown on the invoice.
If payment is overdue, I may pause work on the project until the outstanding amount has been paid.
Any resulting delay to the project timeline will not be the responsibility of Pawfectly Designed.
5. Your Responsibilities
For your project to run smoothly, you agree to provide the information, content and access reasonably required to complete the work.
This may include:
- business information
- written content
- photographs and other images
- logos and branding
- contact details
- social media links
- WordPress or hosting access
- domain information
- product or service information
- feedback and approvals
You are responsible for ensuring that any content, photographs, logos or other materials you provide are yours to use or that you have permission to use them.
If you provide content that infringes someone else’s copyright, trademark or other rights, you remain responsible for that content.
6. Content and Images
Unless otherwise agreed, you are responsible for providing the final wording and business information required for your website.
I may provide guidance, editing or content support where this is included in your chosen service.
Where images are supplied by you, you confirm that you have the appropriate rights or permissions to use them.
Where Pawfectly Designed sources images, graphics, fonts or other third-party resources, these will be subject to the relevant licence or usage terms.
I will not knowingly use materials that I do not have permission to use.
7. Website Design and Revisions
Your website will be designed according to the agreed brief and package.
The number of revision rounds included will be stated in your quotation.
Revisions are intended to refine the agreed design and content. They do not include completely changing the direction of the project or adding substantial new functionality.
If you decide to change the agreed scope of the project, I will let you know if additional charges or time are likely to apply before carrying out the additional work.
8. Project Timescales
I will provide an estimated project timeframe where possible.
Website projects depend on receiving information, content, feedback and approvals from you, so the timeframe may change if these are delayed.
If you take longer than reasonably expected to provide required content or feedback, the project may be moved to a later available slot.
I will keep you informed if there are significant changes to the expected timeframe.
9. Client Approval
Before your website is launched, you will be given an opportunity to review the completed work.
You are responsible for checking the website carefully, including:
- spelling and grammar
- contact details
- prices
- links
- services
- images
- business information
- legal information
- forms
- functionality
Once you have approved the website for launch, further changes may be chargeable depending on the nature of the changes.
10. Website Launch
The website will normally be launched once:
- the agreed work has been completed
- you have approved the website
- any required final payment has been received
- required hosting/domain access has been provided
Once the website is live, you are responsible for ensuring that your business information remains accurate and up to date unless you have an ongoing care or support package with Pawfectly Designed.
11. Hosting, Domains and Third-Party Services
Website hosting, domain registration, premium plugins, themes, email services, stock imagery, software subscriptions and other third-party services are not included unless specifically stated in your quotation.
Where third-party services are required, you may need to purchase and maintain your own account.
Pawfectly Designed cannot guarantee the continued availability, pricing, compatibility or functionality of third-party services.
If a third-party service changes, becomes unavailable or introduces a technical issue, I will do my best to help, but additional work may be chargeable.
12. WordPress, Plugins and Updates
WordPress websites rely on software, themes and plugins which may be updated by their developers.
If you do not have an ongoing website care package, Pawfectly Designed is not responsible for problems caused by future WordPress, theme or plugin updates carried out after the project has been completed.
Where ongoing care and support has been purchased, the services included will be set out separately.
13. Website Care and Support
If you purchase ongoing website care or support, the exact services included will be stated in your package or agreement.
Support may include things such as:
- WordPress updates
- plugin updates
- minor content changes
- website checks
- troubleshooting
- backups
Major redesigns, new pages, new functionality and substantial content changes are not included unless specifically stated.
14. SEO Services
SEO setup is intended to provide your website with a solid foundation for search engine visibility.
However, Pawfectly Designed cannot guarantee specific search engine rankings, traffic levels, enquiries or sales.
Search engines regularly change their algorithms and rankings are affected by many factors outside my control.
SEO services therefore do not constitute a promise of a particular Google position or level of traffic.
15. Intellectual Property and Website Ownership
Once all invoices relating to your project have been paid in full, you will own the final website design and original content created specifically for your project, subject to the terms below.
Third-party materials remain subject to their own licences.
This may include:
- WordPress
- themes
- plugins
- fonts
- stock images
- software
- third-party integrations
You do not automatically receive ownership of third-party software or licences simply because they have been used on your website.
Pawfectly Designed retains ownership of any pre-existing templates, systems, processes, reusable design elements or resources that were created independently of your project.
16. Portfolio and Marketing
With your permission, Pawfectly Designed may display your completed website as part of its portfolio and marketing materials.
This may include:
- screenshots of your website
- your business name
- a link to your website
- social media posts
- case studies
If you would prefer your website not to be used in my portfolio or marketing, please let me know before the project begins.
17. Confidentiality
I will treat information you provide about your business as confidential and will not knowingly share confidential business information with third parties except where reasonably necessary to provide the agreed services or where required by law.
You agree not to share confidential information relating to Pawfectly Designed’s internal processes, pricing arrangements or proprietary resources without permission.
18. Cancellation
If you need to cancel your project, please contact me as soon as possible in writing.
If work has already started, the amount payable will depend on the work already completed and any costs that Pawfectly Designed has reasonably incurred on your behalf.
Where you are legally entitled to cancel under applicable consumer law, nothing in these Terms & Conditions removes those rights.
For projects beginning within a statutory cancellation period, I may require your express request for work to begin before that period has ended. Where applicable, you may be responsible for paying a proportionate amount for services already provided before cancellation.
19. Changes or Cancellation by Pawfectly Designed
I reserve the right to decline or cancel a project in circumstances where it is no longer reasonably possible to complete the agreed work.
If I cancel a project before completing the agreed services, I will explain the reason and refund any amount paid for work that has not been provided, subject to any lawful deductions for work already completed or costs properly incurred.
I will always aim to give you as much notice as reasonably possible.
20. Delays Outside My Control
Sometimes things happen that neither of us can reasonably control.
This may include:
- hosting outages
- domain issues
- software failures
- third-party service outages
- serious illness
- technical problems
- internet or power failures
- other circumstances outside reasonable control
If something like this affects your project, I will keep you informed and do my best to minimise the impact.
21. Liability
I will provide services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.
I am not responsible for losses caused by information, content, instructions or materials supplied by you, or by third-party services outside my control.
I am also not responsible for indirect losses such as loss of profit, loss of business or loss of opportunity where the law allows such limitations.
22. Complaints
I want you to be happy with your website and will always try to resolve problems informally first.
If you have a concern, please contact:
Please explain the issue and, where possible, what you would like me to do to resolve it.
I will acknowledge your complaint and aim to respond within 28 business days.
23. Changes to These Terms
I may update these Terms & Conditions from time to time.
The version applying to your project will normally be the version that you agreed to when you booked the service, unless a change is required by law or both parties agree to an updated arrangement.
The latest version will always be available on this website.
24. Governing Law
These Terms & Conditions are governed by the law of Scotland.
Any disputes will be dealt with by the courts of Scotland, subject to any rights you may have under applicable consumer law.
25. Contact
If you have any questions about these Terms & Conditions, please get in touch.
